Rent Agreement

A rent agreement is a legal contract between a landlord and tenant, outlining terms like rent, duration, and responsibilities to avoid future disputes.

RENT AGREEMENT

This agreement is made between:

 

(Name of Owner) S/o (Father Name of Owner) aged (Age of owner) years residing at (Address of Owner) 

(hereinafter jointly and severally called the “OWNER”, which expression shall include their heirs, legal representatives, successors and assigns) of the ONE PART:

 

AND

 

(Firm Name) through its (Director/ Partner/ Proprietor/ Karta/ Trustee/ President) ( Name) registered at (Address of the Firm)                                                                                                                                                   

(hereinafter called the “TENANT”, which expression shall include its legal representatives, successors and assigns) of the OTHER PART.

 

Where the First Party is the owner of a premise located at (Address of the premises).

 

The First Party wants to give on rent his said premise to the Second Party, where Second Party through its (Director/ Partner/ Proprietor/ Karta/ Trustee/ President) is also want to take this premise on rent. So that with the mutual agreement of both parties the First Party is giving on rent the said premise to the Second Party for (Time in Months/ Years) starting from (Starting date) to (Ending date).

 

The agreement terms are as follows:

  1. Rent Payment
    The rent of the said premises will be Rs. (Amount of Rent)  per month, which will be paid by the Second Party to the First Party monthly, in advance, in the first week of every month.
  2. Fixed Term Payment
    The Second Party is bound to pay rent for all (Time in Months/ Years), whether the premises are in use or not.
  3. Purpose of Use
    The Second Party will use this premises to set up (Use case of property like residence / office)
  4. Restriction on Hazardous Materials
    The Second Party shall not keep any flammable, illegal goods, or hazardous substances such as explosives, etc.
  5. Prohibition of Subletting
    The Second Party shall not sublet, assign, or transfer the premises to any other person under any condition without prior written consent from the First Party.
  6. Responsibility for Damages
    If any damages or loss occur to the premises due to the actions of the Second Party or any member associated with them, the Second Party is fully responsible for covering all expenses to repair the damages.
  7. Penalties or Fines
    If any penalty or fine is levied by a government or other regulatory body due to actions related to the Second Party's usage of the premises, including electricity-related fines, the Second Party shall bear full responsibility.
  8. Theft or Fire
    The First Party is not responsible for any loss or damage to the goods or accessories belonging to the Second Party in case of theft, fire, or other unforeseen circumstances.
  9. Alterations to the Premises
    The Second Party shall not make any alterations, additions, or changes to the premises without prior written consent from the First Party.
  1. Termination of Tenancy
    The tenancy shall only be terminated as per the provisions of the Rajasthan Rent Control Act. Both parties agree to abide by the notice periods and grounds specified under the Act for termination.
  2. Security Deposit
    The Second Party shall pay a security deposit of Rs. (Security deposit amount ), refundable at the end of the tenancy period after adjusting any unpaid dues or damages.
  3. Maintenance of Premises
    The Second Party is responsible for maintaining the premises in good condition. Any repairs required due to negligence or misuse by the Second Party must be borne by them.
  4. Inspection Rights
    The First Party reserves the right to inspect the premises with prior notice to the Second Party to ensure compliance with the agreement terms.
  5. Resolution of Disputes
    In case of any disputes, both parties agree to resolve the matter through arbitration or by approaching the Rent Tribunal as per the Rent Control Act.
  6. Possession of Premises
    Upon the expiry or termination of the agreement, the Second Party shall hand over vacant possession of the premises to the First Party in its original condition, subject to reasonable wear and tear.
  7. Rent Revision
    Any future increase in rent shall be governed as per the terms agreed between both parties or as prescribed under the Rent Control Act.

 

This agreement is signed by both parties on (Date of agreement) with the witnesses. In which the Original copy of the agreement shall be kept to the First Party and the Duplicate copy shall be kept to the Second Party.
